Who Owns the Care? A Three-Page Nursing-Home Ownership & Contract Checklist
A three-page field guide to identify the legal operator, review five ownership/care signals and ask focused contract questions.
Read the complete checklist below. The original PDF has 3 pages.

01 / Identify the facility behind the name
Start with the exact facility, not the brand. This three-page field guide organizes public ownership, care-quality and contract checks. It identifies questions; it does not assign a fraud score or determine which placement is clinically appropriate.
- Record the legal operator, street address and CMS Certification Number (CCN). Keep the marketing name separately.
- Save the date and source of each owner, chain and staffing lookup. Different files may use different reporting periods.
- Confirm whether the setting is a Medicare/Medicaid nursing facility or state-licensed assisted living; the same federal datasets do not cover every setting.
- List the reported property owner and manager if available. Mark an unknown relationship as unresolved rather than independent.

02 / Five signals that deserve questions
One signal does not establish extraction. Look for a documented pattern and an explanation that connects the relationship, charge or care concern to evidence.
- A blank owner field is a data gap, not proof of independence.
- Reported rent is not automatically profit, fraud or a dollar-for-dollar Medicare reimbursement.
- A quarterly staffing average does not reveal every shift or each resident’s bedside care.
| Signal | What to verify |
|---|---|
| Unclear legal operator | Does the contract name match the facility record and address? |
| Connected landlord or manager | Who controls each party, what service is supplied and how is the charge explained? |
| Staffing instability | Check dated RN/total hours, weekends, turnover and missing-data flags. |
| Repeated serious care findings | Read the actual inspection findings and correction status, beyond the overall stars. |
| Pressure to sign unclear terms | Ask about payment guarantees, optional arbitration and the entity responsible. |

03 / Ask, save and choose the next route
Use a short written question, preserve the response and keep care concerns separate from financial research. Nursing-home stars and nursing-home studies should not be applied automatically to assisted living.
- Read who signs and who pays. Covered facilities cannot require a third-party personal guarantee as an admission/continued-stay condition; payment from lawfully accessible resident funds is a different arrangement.
- Binding arbitration cannot be an admission/continued-care condition in a covered facility. The agreement must expressly allow rescission within 30 calendar days.
- Visit and ask about actual care arrangements. Contact the state long-term-care ombudsman or survey/licensing agency for the relevant concern.
- For immediate danger, seek emergency assistance; do not wait for an ownership investigation.
For [facility / CCN], please confirm the legal operator and identify the property and management entities involved in our agreement. Please explain [specific fee or clause] and provide the relevant current policy or document available to residents. We are seeking a clear record of responsibility, services and charges.
