HHS OIG audit A-07-21-02836: related-party costs
The $65.4 bn is reported expenditure, not all profit, fraud, Medicare-funded dollars, or PE-only activity. The 14 cases are not a national error-rate estimate. Medicare SNF prospective payments are not dollar-for-dollar reimbursement of every reported cost. Two guidance recommendations closed implemented July 1 2026; the routine-review recommendation remains open on the tracker.
Read the primary sourceGAO-23-106163: identifying private-equity nursing-home ownership
Historical 2022 estimate, not a 2026 census. GAO found missing owner records; absence of a sponsor name is not proof of independence. Do not equate all for-profit or chain ownership with PE.

4.2 m first short-stay fee-for-service Medicare patients, index stays 2005–2016; facility data 2000–2017. Mortality includes stay plus 90 days after discharge. IV is a local average treatment effect, not 11 percentage points or every resident. Patient selection and heterogeneous effects matter. Finance estimates are historical averages, not a named operator’s invoices.

Core identification uses Illinois cost reports 2000–2021. This is a profit estimate, not 68% of revenue, Medicare payments, or money stolen nationwide; not PE-only. Earlier 2024 version reported 63%; do not mix versions. IRRs and staffing reallocations are model estimates. Authors find little evidence of clinical/operational changes specifically on related-party adoption.

Includes landlords, financial/cash-management and management services; not limited to direct equity owners. Medicaid collection is through states. Reporting implementation and the later suspended off-cycle deadline must be distinguished from enactment. Use S 06/S 07 for current submission status, not the old fact-sheet research percentages.

Checked October 25 2026. This suspends a submission deadline; it does not erase all ownership law or all ordinary change-of-information duties.
Read the primary sourceCMS Form 855 A SNF Attachment guidance, February 24 2026
Applies only to SNFs. Pending initial/reactivation/CHOW applications can continue processing, but final CMS approval awaits the completed attachment. Do not confuse an ownership% threshold with proof of effective control; indirect control also matters.

Attribute coverage figure to the senators’ letter and its February 2026 snapshot. A request to CMS is not a court judgment, enacted statute, or proof every LLC is abusive.
Read the primary source2019 congressional inquiry into PE nursing-home care
Historical inquiry, not a conviction or proof of 2026 ownership by each firm. Do not transpose the separate Senate hospital investigation onto nursing-home outcomes.
Read the primary sourceCMS Skilled Nursing Facility All Owners dataset
Retain the downloaded dataset date and match the correct facility using identifiers/location. Missing records do not establish no PE/REIT connection. Do not publish private residential addresses from records as a call to contact owners.
Read the primary sourceCMS Nursing Home Chain Performance Measures and Care Compare update
Compare both facility and chain, rather than assigning every home its group average. A chain is not automatically PE. Dataset snapshots and facility-level files can have different refresh dates.

Use dates, case mix and missing-data flags. Do not turn a daily or quarterly average into a promise of individual bedside minutes.

Do not repeat the old three-standard-survey formula. PBJ staffing is quarterly and case-mix adjusted. The summary cautions that ratings cannot replace visits or assessment of personal care needs.

Related-party contracting can be lawful. An invoice amount and an allowable reported cost are different concepts. This rule does not make every rental or management fee fraud.
Read the primary sourceHHS repeal of 2024 numerical nursing-home staffing provisions
Do not claim the 2024 numerical standard is currently enforceable. Existing federal sufficient-staff obligations and state-specific standards remain separate. HHS cited workforce shortages and rural/Tribal access in its rationale.

Do not extend a Medicare nursing-home mortality estimate or CMS nursing-home star rating to every assisted-living facility. Medicaid HCBS coverage and eligibility differ by state.

Do not suggest a full long-term placement is automatically funded by Medicare, or promise Medicaid eligibility, all costs, or 100 covered days to every resident.

A resident advocate is not an emergency response service or a guarantee of litigation recovery. Use the official program/state locator for current contacts.

Do not tell families simply to stop paying or conceal assets. Identify the actual resident/representative obligation and obtain qualified state-specific help for disputes or Medicaid planning.

Current subsection is(m), not older(n). Enforceability and other legal issues are fact/state specific; do not guarantee all signed contracts can be cancelled without consequences.

Attribute findings to OSC. Its proposed~$123.9 m recovery was sought, not an adjudicated amount already collected. Owners’ counsel disputed methodology and argued mortgages were common/HUD-approved; OSC rejected those defenses. This is a common-owner case, not proof the owners are a named PE fund. Current litigation/disposition beyond the report was not established.
